If your wireless device is determined to be defective during the normal and customary use of the device for a period of 90 days from the date you receive it, uBreakiFix® by Asurion will, at their sole discretion, provide a replacement device or reimburse you the original purchase price you paid for your wireless device plus any applicable tax paid.
This limited warranty does not provide coverage for devices which have been subjected to abuse, misuse, exposure to abnormal or hazardous environmental conditions or other conditions beyond normal wear and tear. Act of God, normal wear and tear that does not affect the original manufacturer’s intended use, battery leakage, or damage resulting from battery leakage. This limited warranty is non-transferable and does not apply to devices on which the serial number has been altered, defaced, or removed.
If your device is found to be defective, please contact us for a refund or replacement device. The replacement device may have been previously opened and/or used, may be refurbished or remanufactured, and may contain original and/or non-original manufacturer parts of the same or similar models or like kind and quality.
THIS WARRANTY AND THE REMEDIES SET FORTH IN IT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OF USE, SHALL BE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. OTHERWISE THE REMEDIES PROVIDED UNDER THIS LIMITED WARRANTY ARE THE EXCLUSIVE REMEDIES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE, WHETHER IN CONTRACT OR TORT, INCLUDING NEGLIGENCE, FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, SOFTWARE OR APPLICATIONS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE DEVICE.
